Andrew Branca writing for Legal Insurrection has highlighted yet another case where a white man shot a black teen. This is a case in New Orleans.
The teen had entered the man’s property at 2.00 am so there is a certain amount of intent to burglary involved here. The man heard his dog barking and went to investigate. He says the teen moved his hand towards his waistband probably attempting to intimidate him. The man has been charged with attempted 2nd degree murder.
A few things to note about this particular case that has been brought up in comments. First, it seems that the family of the teen are struggling, in that the father died as a result of cancer, leaving the oldest son helping his mother to bring up his siblings. Second, the brother of the victim (who is still alive) has more or less admitted that his brother was doing the wrong thing at the time of the shooting and that the victim has a rap sheet for burglary. Third: there is video footage that shows the victim entering the property.
Since I am not qualified to comment on laws in the USA, I defer to Andrew Branca who is an expert in the area of self-defense.
The overcharging of this man is interesting. It appears that the police have a witness who contradicts the man’s story, plus there is the evidence angle. We shall wait and see. I would have thought that this is a case for a grand jury to decide.
There is another Texas case also caught on CCTV concerning a black woman on black male homicide. The question is again whether or not the woman acted in self-defense when she shot and killed the man. Her reactions immediately after the shooting were weird. I do hope that Andrew will keep us updated on whether or not the woman will be charged or what took place was considered to be self-defense.
